Overview
What is compassionate release of super?
The Australian Taxation Office (ATO) allows early access to preserved superannuation on compassionate grounds in strictly limited circumstances, including necessary medical treatment — which can include dental treatment. This is governed by regulations under the Superannuation Industry (Supervision) Regulations 1994.
To qualify, treatment generally must be needed to:
Treat a life-threatening illness or injury
Where there is a likelihood of severe degeneration or death within 12 months without treatment.
Alleviate acute or chronic pain
Chronic pain is typically pain of at least three months’ duration; acute pain implies rapid onset requiring urgency.
Alleviate acute or chronic mental illness
Where the treatment is necessary to address a diagnosed condition.
Where dental may apply
Conditions such as severe periodontal disease, ongoing infection, TMJ issues, or tooth-related chronic pain affecting quality of life — where treatment meets ATO criteria and is not readily available publicly.
Eligibility
What the ATO requires
Applications are assessed case by case. Eligibility is strict, and the expense must be for necessary treatment only — not cosmetic or elective procedures.
- Two separate reports from registered practitioners. For dental cases this can be two dental practitioners, or one medical and one dental practitioner — at least one appropriately specialised.
- Reports must certify the treatment is necessary to alleviate the qualifying condition and is not readily available through the public system.
- A detailed treatment plan covering all stages, with an itemised quote or invoice.
- Confirmation the treatment is necessary care, not cosmetic or elective.
The Process
How an application works
The application is the patient’s responsibility and is made directly to the ATO. The steps below are a general guide.
Consult your dentist or doctor
An in-person assessment is preferred — a thorough history, examination, and diagnostics are required.
Obtain the required reports
Your practitioners complete the necessary medical/dental reports (ATO form NAT 74927).
Submit your application to the ATO
Apply via myGov (or the appropriate channel) with all supporting documents.
If approved, funds are released
Funds are paid to you or directly to the provider. Tax implications apply.
